In this paper the author analyzes the complex issue of the instant murder. In the first part of the paper the author deals with the sudden passion, its nature, intensity, duration, impact on the psychological activities, as well as its criminal and legal importance. ... [Show full abstract] expresses his opinion on the legal nature of the instant murder, and afterwards analyzes the elements of this crime in detail. In the last part of the paper, the author draws certain conclusions that demonstrate how difficult it is to prove this crime in practice. He also underlines that the sudden passion, as an element of the crime of instant murder, is unique since it has to be strong, inculpable and morally forgivable. As such, it reduces the guilt, by influencing its psychological and its normative dimension. This conclusion may also be supported by the penalty prescribed for this crime.
