New legislation to create an inventory of U.S. levees was supported by witnesses at a 6 April hearing of the U.S. House of Representatives Transportation Subcommittee on Water Resources and Environment. The Levee Safety Program Act of 2005, H.R. 4650, would authorize the U.S. Army Corps of Engineers to inspect levees constructed or maintained by the Corps or other levees upon a governor's request. The Corps would create and maintain an inventory of levees and issue safety guidelines.

Procedures for Individual Education Programs that are in accordance with federal legislation are delineated. To satisfy federal mandates concerning the placement of handicapped children, public school systems are required to utilize a least restrictive environment, whereby complete segregation of handicapped from nonhandicapped children is prohibited. In further accordance with this legislation, either the parent or public agency may initiate a hearing for the purpose of challenging the identification, evaluation, or educational placement of the child.

II Foreword Recent years have witnessed rapid and profound changes in the world of work, both in regard to work organisation and the content of work. New forms of work organisation, such as outsourcing and contracting out, are increasingly common. This tendency has contributed to the emergence of economically dependent work which represents a form of work falling within a "grey zone" between ... [Show full abstract] subordinate work and self-employment. There are different terms which have been developed in order to describe and categorise this group of workers -those most frequently used being: 'economically dependent workers', 'parasubordinate workers' (quasi-subordinate workers) or 'persons similar to wage earners'. In legal terms economically dependent workers are self-employed. The basic and common characteristic of these workers is that they are similar to self-employed in so far as they work at their own risk and are not subordinate to an employer. At the same time, they are 'economically dependent' in the sense that they are more or less exclusively reliant on just one client enterprise. In the year 2000 the Commission raised the issue of economically dependent work in the consultation of the social partners on the modernisation and improvement of employment relations. The social partners and the Commission agreed that more information and research was necessary. Furthermore, in its legislative resolution on the Council common position on the Directive amending the Insolvency Directive, the European Parliament called on the Commission to carry out an in-depth study and to hold a joint public hearing with Parliament on economically dependent workers. As a result of these requests, the Commission launched the study "Economically dependant work/ Parasubordination: legal, social and economic aspects". The purpose of the study was to provide a detailed and comprehensive overview of the legal, social and economic situation in relation to economically dependent work in the Member States.

In November 2006 the House of Commons approved a series of changes recommended by its Select Committee on Modernisation that altered the procedures by which parliament scrutinises government bills. The committee stage of the legislative process in the House of Commons, the stage where bills are examined in detail, was overhauled in the interests of achieving enhanced scrutiny and a more informed ... [Show full abstract] and accessible legislative process. Standing committees, as were, were re-named ‘public bill committees’ and endowed with the power to call witnesses and receive written submissions from interested and expert bodies external to parliament, in the course of their scrutiny of a bill. To a limited extent, these committees have become more like select committees. The introduction of public bill committees was an important innovation in the way the House of Commons scrutinises legislation. But it has not been subject to any evaluation. We encouraged Jessica Levy to pursue her Masters dissertation at UCL on this topic. It was a good dissertation, so she was later invited to develop it - following further research - into a report for the Constitution Unit. This is the result. The report draws on a series of almost 30 interviews with many of the key players in public bill committees to date – government and opposition spokespersons, backbenchers, clerks and witnesses – and an examination of documents relating to all such committees in the 2006-07 and 2007-08 sessions. It is the first comprehensive study to review the work of the new committees. Public bill committees have been described as ‘a step and a half in the right direction.’ In this report Jessica sets out many of their benefits, and also recommends a series of further improvements. If her recommendations are accepted, these important new committees will be moving more strongly in the right direction and making a real contribution to the scrutiny of legislation.

[Show full abstract] comparison provides insight into behavior patterns of agencies, and into the effectiveness of new legislative mandates in bringing about changes in administrative behavior. This study compares two water resource development programs, the Civil Works Program of the Army Corps of Engineers and the Small Watersheds Program of the Soil Conservation Service (SCS). It appears that NEPA did force action by the Federal water resource agencies, but that it did so in different ways and with varying degrees of effectiveness. Both organizational characteristics and political pressures were of major significance in determining the magnitude, speed, and character of the agencies' responses. (MCW)

[Show full abstract] several marine sanctuary bills had been before both houses on various occasions, and it was never before a Senate Committee, having been added only in conference.3 Even in the House, committee hearings were never held on Title III.4 In both houses, objections were raised to the proposed legislation on the floor, on the grounds that it created statutory authority that overlapped that of the Department of the Interior under the Outer Continental Shelf Lands Act (OCSLA) and that it would lead to administrative conflicts on the administration of OCS areas for oil and gas development.5 Objections were also raised concerning international questions raised by the bill, since it applied to marine areas, outside the territorial sea, overlying the OCS of the United States;6 management authority over most of the living marine resources of such areas was not actually asserted by the United States until 1976, with passage of the FCMA. In response to the latter objections, a clause was added to the bill stipulating that its provisions would be applied to foreign nationals only in accordance with recognized principles of international law.7 Title III was opposed by the Nixon administration on both these grounds.8

Pre-Appointment Scrutiny Hearings in the British House of Commons: All Bark, or Some Bite?

This was initially welcomed by MPs, who viewed it as an important step towards limiting executive power and strengthening the role of parliament. However, following the appointment of the Children's Commissioner against the advice of the ... [Show full abstract] relevant select committee, many MPs became disillusioned with the hearings. Based on extensive interviews with those involved in the appointments process, this article argues that while committees may lack formal veto power over appointments, they do have considerable influence. Most candidates said they would not have taken up their appointment against the advice of the select committee. So pre-appointment hearings should not be dismissed as pointless, but rather seen as an important mechanism through which committees can exert influence over public appointments. This tells us two important things about the powers of legislatures. First, it confirms that legislative influence is far more subtle than the simple exercise of veto powers, as scholars have long noted. But second, it also demonstrates that even the most central actors in the process (the MPs) may not appreciate this fact.
